SPP announces updated compensation standard for infringement upon personal liberty

The Supreme People's Procuratorate (SPP) has issued a notice updating the standard of compensation for cases involving infringement upon citizens' personal liberty, in accordance with the latest wage data released by the National Bureau of Statistics on May 16.

According to the data, the average annual salary of employees in urban non-private entities in 2024 was 124,110 yuan ($17,240), with the average daily wage calculated at 475.52 yuan.

In accordance with Article 33 of the State Compensation Law, which stipulates that compensation for infringement upon a citizen's personal liberty shall be calculated based on the average daily wage of employees in the previous year, and Paragraph 2 of Article 21 in the judicial interpretation concerning the application of law in the handling of criminal compensation cases that was jointly issued by the Supreme People's Court and the SPP, the SPP requires that, starting from May 19, 2025, procuratorates at all levels calculate compensation for infringement upon a citizen's personal liberty at the daily wage of 475.52 yuan.
